FRANK M. CICERO – PRINCIPAL

Frank Cicero is the president and majority owner of Cicero Consulting Associates and began his career in this field in 1989. He is primarily responsible for coordinating the preparation and submission of all C.O.N. and other applications/grant proposals, and monitoring submitted applications through the governmental review process.

Preparation of applications includes drafting programmatic narratives, developing need analyses, developing budgets and other financial projections, and working with architectural and legal professionals to coordinate these sections of applications. During the governmental review process, Mr. Cicero is responsible for coordinating the firm’s interactions with the NYSDOH and other local, regional, State and Federal agencies. This includes attending and presenting at public review meetings, submitting additional project information and meeting with staff of review agencies relative to projects. In addition to the above duties, Mr. Cicero is extensively involved in the firm’s planning functions. He is responsible for monitoring State and national health care trends and providing firm staff with information relative to the planning needs of the firm’s clients and is part of the firm’s management and financial analysis team, with specialties in productivity analysis and capital planning. He has also prepared successful managed care RFP responses relative to New York State’s Partnership Plan, Child Health Plus program and Commonwealth/Long Term Care Managed Care program.

Mr. Cicero is a 1985 graduate of Dartmouth College and a 1993 graduate of the Harvard School of Public Health, where he received a M.S. degree in health policy and management. During his two years at Harvard, he also served as an intern in the Finance Department of Columbia-Presbyterian Medical Center and in the Planning Department of MetroWest Medical Center in Framingham, Mass. After graduating from Harvard, he spent one year working for the New York City Health & Hospitals Corporation in the Corporation’s Capital Finance Department.

Mike Cicero joined Cicero Consulting Associates in 2009 and is one of the firm’s three owners. He is the firm’s lead ASC, nursing home and home health agency consultant and is primarily responsible for coordinating the preparation and submission of C.O.N. and other applications/grant proposals. In addition, Mr. Cicero is involved extensively in the firm’s planning functions. He is responsible for monitoring State and national health care trends and regulatory developments and provides firm staff with information relative to the planning needs of the firm’s clients.

Mr. Cicero has regularly attended the meetings of the Health Planning Committee of the NYS Public Health and Health Planning Council (PHHPC) since 2010, at which the Committee discussed, among other things, proposed regulatory changes to the C.O.N. program and the delivery and regulatory oversight of home health care and ambulatory care services throughout New York State, including the provision of urgent care services by Article 28 and non-Article 28 providers. Mr. Cicero works regularly with hospitals, ASCs, nursing homes, LHCSAs, CHHAs, D&TCs, dialysis facilities, adult care facilities, hospices and physician groups seeking to convert to Article 28.

Prior to joining the firm, Mr. Cicero practiced law as a commercial litigator for 11 years at White & Case LLP in New York and Day Pitney LLP in New Jersey. Mr. Cicero is a 1995 graduate of Harvard University and a 1999 graduate of Benjamin N. Cardozo School of Law (J.D.; Law Review; and Order of the Coif). He is licensed to practice law in New York, New Jersey and multiple federal courts.

Mr. Ungerer has worked with a vast array of healthcare providers, including hospitals, D&TCs, ASCs, dialysis facilities, nursing homes and assisted living providers, among others. In addition, Mr. Ungerer collaborates with providers, architects, attorneys and NYSDOH staff on projects. As part of the C.O.N. Application development and review process, Mr. Ungerer provides strategic guidance to clients regarding projects, specifically where the policy and planning realms coincide.

Mr. Ungerer is a 2001 graduate of Colgate University. After his undergraduate studies, Mr. Ungerer enrolled in the Columbia University Mailman School of Public Health, where he received a Master of Public Health (MPH) degree in health policy and management in 2003. During his two years at Columbia, Mr. Ungerer undertook two separate year-long internships – one within the Bureau of Environmental and Occupational Epidemiology at the New York City Department of Health and Mental Hygiene and one within the Oncology Service Line at New York-Presbyterian Hospital. Mr. Ungerer also received a Master of Business Administration (MBA) degree from the Kellogg School of Management at Northwestern University in 2014.

CHARLES F. MURPHY, JR.

Charlie Murphy began working with Cicero Consulting Associates after nearly 30 years of experience with the NYSDOH. He provides C.O.N. and planning consultative services.

Mr. Murphy spent virtually his entire career in the NYSDOH C.O.N. health planning program. His work at the NYSDOH concentrated initially on financial feasibility analysis, where he served first as a staff member and, for 15 years, as Director of the Bureau of Financial Analysis within the Office of Health Systems Management. In the mid-1990s, Mr. Murphy was asked to oversee the NYSDOH’s health planning activities and was appointed Director of the Division of Health Facility Planning. As Director, Mr. Murphy headed a group of 60 professional and support staff in the review, approval and monitoring of approximately 500 health facility construction projects annually submitted by every segment of the provider community, including hospitals, nursing homes, diagnostic and treatment centers and others. Under Mr. Murphy’s leadership, “Obligated Group Financing” was introduced in New York State, to provide health care networks improved access to the capital markets by utilizing the collective strength of the member institutions rather than relying on the financial condition of the individual facility proposing construction. This program saved member facilities, and taxpayers, millions of dollars annually. Working with mortgage bankers, Mr. Murphy spearheaded an effort to allow low-cost Industrial Development Agency bonds to be utilized to finance hospital construction projects in New York, again, saving hospitals considerable time and expense.

Mr. Murphy graduated from Siena College with a degree in Economics and completed graduate course work in Urban Planning at the State University of New York at Albany.

NOELIA CHUNG

Noelia Chung joined Cicero Consulting Associates in 2006. Her primary responsibilities include the preparation and submission of C.O.N. Applications, including need analyses, developing budgets and other financial projections, and working with architectural and legal professionals to coordinate various components of applications.

She has worked with a vast array of healthcare providers, including hospitals, D&TCs (including numerous FQHCs), ASCs, dialysis facilities, nursing homes and assisted living providers, among others. Ms. Chung collaborates with providers, architects, attorneys and NYSDOH staff to see projects through to approval. As part of the C.O.N. Application development and review process, Ms. Chung provides strategic guidance to clients regarding projects, specifically where the policy and planning realms coincide. Ms. Chung has also prepared many successful grant proposals, including Statewide Health Care Facility Transformation Program, HEAL-NY, Capital Restructuring Financing Program, and others.

Ms. Chung is a 2002 graduate of Smith College, where she received a B.A. in American Studies. She received a Master of Public Health (MPH) in health policy and management in 2004 from the Mailman School of Public Health at Columbia University. Prior to joining the firm, she worked as a press intern in the New York City Department of Health and Mental Hygiene and as a Program Coordinator for the IT Training Program at Morgan Stanley.

DANIEL RINALDI, JR.

Dan Rinaldi began working with Cicero Consulting Associates in 2013. He coordinates the preparation and submission of C.O.N. applications/grant proposals for nursing homes, ASCs, adult care facilities, home health agencies and other healthcare providers.

Mr. Rinaldi has strong knowledge of accounting concepts, the public health law and associated regulations, and he is highly skilled at preparing operating budgets and financial feasibility studies for all healthcare facilities and agencies, especially nursing homes, adult care facilities, home health agencies and ASCs.

Mr. Rinaldi graduated from Marist College in 1994 with a degree in Accounting and completed graduate course work in Business Administration. He received his J.D. from New York Law School in 1997. Prior to joining the firm, Mr. Rinaldi worked in a wide variety of industries, including public accounting firms and hospital accounting departments.

MICHAEL MAIALE

Mike Maiale began working with Cicero Consulting Associates in 2015. He provides public health consulting services to health systems, hospitals, physicians, ASCs, dialysis centers, community health centers, and ACFs.

Mike spent nearly 15 years as a hospital executive in New York, New Jersey and Pennsylvania, most recently serving as a Vice President at Robert Wood Johnson University Health System in New Jersey. He is a 2002 graduate of the SUNY New Paltz School of Business and a 2005 graduate (MBA) of Mount Saint Mary College. Mike is an adjunct lecturer at the SUNY New Paltz School of Business.

ROSEMARIE PORCO-NASH

Rosemarie Porco-Nash began working with Cicero Consulting Associates in 2011. She specializes in ACF, LHCSA and CHHA projects and is primarily responsible for coordinating the preparation and submission of ACF Applications, LHCSA Applications and other applications/grant proposals.

In addition, Ms. Porco-Nash regularly assists the firm with preparing need studies for adult homes, enriched housing programs, assisted living residences, enhanced assisted living residences and special needs assisted living residences. Ms. Porco-Nash works regularly with facilities and agencies seeking initial licensure, change of operator, change of ownership and other types of transactions requiring NYSDOH approval.

Prior to 2011, Ms. Porco-Nash was under contract with the SUNY Research Foundation for five years, assigned to the Division of Adult Care Facility and Assisted Living Surveillance of the NYSDOH as a project manager. Additionally, Ms. Porco-Nash was a senior financial analyst for 18 years with MediaVest, a top advertising agency in New York City; and prior to joining MediaVest was a senior bookkeeper for 13 years with American Brands/American Tobacco Company, also located in New York City.

JACOB RAMSEY

Jake Ramsey began working with Cicero Consulting Associates in 2024. His primary responsibilities include the preparation and submission of C.O.N. and other applications.

Mr. Ramsey works regularly with hospitals, D&TCs, ASCs, adult care facilities and dialysis facilities, among others. As part of the C.O.N. process, Mr. Ramsey assists clients undergoing the NYSDOH Regional Office pre-opening survey process to add new clinical services, relocate services/programs, and/or place newly constructed/renovated spaces into service.

Mr. Ramsey is a 2005 graduate of Indiana University. After undergraduate studies, Mr. Ramsey received a Master of Public Health degree from the University of South Carolina School of Public Health and worked for the state’s Bureau of Disease Control. Mr. Ramsey also received a Master of Health Administration degree from Cornell University in 2013. Prior to joining the firm, Mr. Ramsey worked for Memorial Sloan Kettering Cancer Center, NYU Langone Health, and Hospital for Special Surgery holding operational, strategic, and regulatory positions.

MARY ANN ANGLIN

Mary Ann Anglin began working with Cicero Consulting Associates after more than 32 years of experience in health care including provider licensure and surveillance, health policy development and implementation; the majority of those years were spent with the NYSDOH.

Early in her career, Ms. Anglin worked in the New York State Division of the Budget where her responsibilities included program and policy development for hospital and ambulatory care providers. After 12 years, Ms. Anglin joined the NYSDOH where she was Director of Primary and Community Health Care Development overseeing the Community Health Care Conversion Demonstration Project (CHCCDP), a $1.25 billion project to provide hospitals with funding to make the necessary changes to their operations to transition to a managed care environment. Ms. Anglin concluded her State career in long term care where she was Director of the Division for Home and Community Based Services, overseeing licensure, certification and surveillance of home care and hospice providers, and administration of the Medicaid Waiver programs including Long Term Home Health Care Program, Care at Home, Traumatic Brain Injury, and Nursing Home Transition and Diversion.

Ms. Anglin then provided consulting and strategic planning services to health care providers as a member of Sachs Policy Group. Ms. Anglin received her B.S. from the State University of New York at Albany and her M.S. from Russell Sage College.

KAREN DIETZ

Karen Dietz began working with Cicero Consulting Associates in 2010, after more than 20 years of health care experience, working for several hospital systems in New York State, where her work focused on program and policy development, facility master planning, physician recruitment, strategic planning and regulatory compliance.

Early in her hospital career, Ms. Dietz was Director of Human Resources for an academic medical center, overseeing all aspects of the hiring and recruitment process of hospital staff. Her primary responsibilities include the preparation and submission of NYSDOH C.O.N. Applications, NYSOMH Applications, NYSOASAS Applications and other Applications and Grant proposal documents for providers. Ms. Dietz has worked with a vast array of healthcare providers, including hospitals, D&TCs/FQHCs, ASCs, dialysis facilities, nursing homes, home care programs, mental health programs and substance use disorder treatment programs, among others. As part of the C.O.N. process, Ms. Dietz assists clients undergoing the NYSDOH Regional Office pre-opening survey process to add new clinical services, relocate services/programs, and/or place newly constructed/renovated spaces into service.

Ms. Dietz received her Bachelor of Science in Education degree, with a dual major in special education and elementary education, from Keene State College and a Masters in Public Administration (MPA) degree from Pace University.

PATRICK CLEMENTE

Pat Clemente began working with Cicero Consulting Associates in 2016. His activities with C.O.N. projects are focused on obtaining approvals from the NYSDOH for healthcare providers to utilize new medical facilities, patient care units, clinics and medical equipment.

Such approvals can also grant medical facilities permission to provide patient care services on an inpatient and outpatient basis. Mr. Clemente collaborates with healthcare providers, architects, engineers and medical facility project coordinators to navigate them through the NYSDOH offsite reviews of technical documentation and succeed in handling NYSDOH onsite inspections. Mr. Clemente facilitates the openings of multi-phase complex projects. Mr. Clemente uses his expertise with fire safety codes, physical plant standards and environmental health requirements to assist healthcare facilities in satisfying NYSDOH inspections. Mr. Clemente also conducts on-site evaluations regarding overall fire safety and environmental code compliance and assists during NYSDOH surveys. Mr. Clemente submits project documentation to the NYSDOH on behalf of medical facilities, while also obtaining survey dates for onsite inspections.

Mr. Clemente came to the firm with over 30 years of experience working at the NYSDOH, where he provided regulatory oversight of hospitals, nursing homes, D&TCs, renal dialysis centers, ASCs, and comprehensive outpatient rehabilitation centers. At the NYSDOH, he coordinated the review process for the opening of new medical facilities, establishment of new nursing homes, and initiation of new healthcare services, plus issued project approvals and operating certificates. Mr. Clemente conducted onsite surveys for compliance with State regulations and federal Title 18 requirements regarding environmental health, including fire safety, disaster preparedness, food service, infection control, maintenance and general safety. Mr. Clemente oversaw the statewide collaboration that developed the Environmental Documentation Checklist (EDC), which guides all NYSDOH environmental reviews for C.O.N. projects. Mr. Clemente is a graduate of the University of Pennsylvania.

JAMES MASTERS

Jim Masters began working with Cicero Consulting Associates as a Regional Office Consultant in 2020. Jim is a 2016 retiree of the NYSDOH as a Public Health and Principal Sanitarian.

Jim worked in the Buffalo Rochester Western Regional Office Hospital Program. His primary role was Life Safety Surveyor with a breadth of expertise in Infection Control, Emergency Preparedness, Fire Safety, C.O.N. review and closure. His experience in healthcare covers a wide range of facility types, including hospitals, nursing homes, ASCs, Article 28 outpatient clinics (primary care, dental, behavioral health).

Jim’s education includes AAS-Agronomy Alfred State College, BS-Empire State College Public Organization Behavior/Science. Certifications as a Federal Fire Inspector 1, with Center for Medicare and Medicaid certification in NFPA 99, 101, 101A, and ASCs. Jim continues his post-retirement career working with the firm processing the NYSDOH Regional Office tabs in the NYS Electronic C.O.N. program and he also assists clients with closure and relocation plans. He also continues CMS Federal Accreditation surveys as a Life Safety Surveyor with AAAHC.

BRIAN M. BALDWIN, LCSW-R
Brian Baldwin, LCSW-R began working with Cicero Consulting Associates in 2004. He currently heads Baldwin Consultants, a Behavioral Health Consulting firm operating since 1999.

He works on OMH and OASAS projects, including the establishment of new outpatient, inpatient and residential mental health and substance use treatment programs, and mental health clinic school satellite clinics. For these projects, he provides consultation to the firm’s clients, their clinical staff, their attorneys and architects. He has consulted on the mergers of several large hospital systems as well as the acquisition of behavioral health programs by other organizations and hospitals. As a clinician and a consultant, Mr. Baldwin has provided clinical expertise in every level of inpatient and outpatient behavioral health treatment program. He develops program policies for all levels of outpatient, inpatient and residential mental health and substance use treatment programs that meet all regulatory and clinical standards. He regularly appears before the NYS Behavioral Services Advisory Council to advocate for clients.

In addition to over 30 years as a practicing and supervising clinician and therapist, Mr. Baldwin has extensive experience in Behavioral Health Program Design, Evaluation and Compliance. He has previously worked in the NYSOMH Division of Quality Management and Bureau of Inspection and Certification, and the Commissioner’s Office of the NYSOASAS. In 2006, he received the New York State Senate Liberty Award for volunteer work as a behavioral health clinician responder and team leader after Hurricane Katrina in 2005, providing counseling and other assistance to evacuees in Houston and San Antonio, Texas, as part of the SAMHSA Emergency Response Team. Mr. Baldwin received his MSW from Adelphia University, his MS from St. John’s University and his BA from Manhattan College.
